LOFT33 User

§ 1 Introduction

(1) The Service Design Network (hereinafter referred to as “SDN”) welcomes all service design professionals, students and all other individuals interested in the utilization of the LOFT33, for private use or as a participant of a SDN Event (hereinafter referred to as “(Paying) Users”).

(2) These “Terms & Conditions – LOFT33 User” apply exclusively for the use of the loft33cologne.de website as a Paying User and the use of the SDN Loft33.

(3) Our Loft33 can be booked as a workshop, seminar or event room through our website www.loft33cologne.de. Tickets for exclusive SDN Events like the SDN Academy or the SDN Talks can also be booked through Eventbrite.co.uk.

(4) We may change these terms and conditions at any time without notice by updating this page and if you continue to use this website we will consider that you have accepted any changes.

§ 2 Booking

(1) You will become a Paying User once the booking was successful.  To book, you need to fill in the booking form on our website loft33cologne.de. After receiving your message, we will check you booking details and confirm or negate your request. If the Loft33 is available you need to pay the booking amount, that is defined in §4 Price Components and Methods of Payment. By clicking on the “Submit”– Button during the paying process you become a Paying User. You will have to agree to these Terms & Conditions – LOFT33 User.

(2) Our system will send you a booking conformation or negation after receiving your request. After we have received your payment, we will send you all booking conformation details via E-Mail. Please make sure to also check your spam folder in case the message has been marked as spam.

(3) By sending this Email to you we conclude the LOFT33 – Contract.

(4) We reserve the right to conclude this contract with any potential user.

§ 3 LOFT33 User

SDN welcomes all individuals, companies, private firms or institutions interested in the LOFT33 as a Workshop or Meeting Room. For any other utilization request please send an E-Mail to the info@service-design-network.org.

§ 4 Price Components and Methods of Payment

(1) The utilization fee is 240 EUR per day plus Vat. For SDN Members we offer a reduced price that is 200 EUR per day plus Vat. You can pay with PayPal, credit card or invoice.

(2) You can become an SDN Member via our Website www.service-design-network.org.

(3) The user fee must be paid in full before you can use services. After your booking is received, you will be sent a confirmation of payment for the utilization fee.

(4) You can book the following extra services:

  • Beamer 25 EUR per day
  • Flipchart incl. paper 15 EUR per paper pad
  • Water 15 EUR per box
  • Coffee rate (incl. Powder, Tee, Milk, Sugar, Cookies) 10 EUR per person

§ 5 Users Obligations

(1) As a User you agree not to transmit any illegal or unlawful contents in text or in picture. You are particularly obliged not to publish any contribution

  • that would constitute a crime or administrative offence,
  • that infringes copyrights, trademark rights or competition regulations,
  • that infringes the Legal Services Act (Rechtsdienstleistungsgesetz),
  • that has offending, racist, discriminating or pornographic content,
  • that contains advertisements.

(2) A breach of the obligations stated above entitles SDN to cancel or modify the respective contract. The User can be frozen for an appropriate period of time. SDN remains entitled to claim for further damage caused by violation of this duty.

(3) SDN has the right to cancel contracts of a User that may contain a statutory violation.

(4) SDN has the right to be indemnified by the User against third party claims due to a statutory violation by the User. The User is obligated to support SDN in defending the claim of respective demands and bear the costs for an adequate legal defence.

(5) Comments and other contributions that are published in relation to SDN Academy Workshops and Talks and all other Events that take place in the LOFT33, have to be factually and respectful to SDN and other Users. In case of offences SDN reserves the right to take legal steps against the User and exclude the User from following Events for an appropriate period of time.

(6) As a User you agree to be careful with all SDN facilities. You are liable for damaged facilities that you cause. Resulting costs that rely to damage caused by a User have to be bear by the User.

§ 6 Limitation of Liability

(1) To the maximum extent permitted by law, we accept no responsibility for any lost items.

(2) SDN assumes no liability or responsibility for the accuracy, completeness, reliability, up-to-datedness and usefulness of the provided content of the trainer or renter. Please note that statements of fact and opinion are made on the responsibility of the trainer or renter alone and do not represent the views of SDN.

(3) Claims for damages are excluded unless otherwise agreed below. This exclusion of liability also applies for legal representatives and vicarious agents of SDN.

(4) The liability for the following matters are not limited or excluded: The liability arising from the German Product Liability Act (Produkthaftungsgesetz), liability for assuming a guarantee, liability in case of violation of essential contractual obligations (cardinal obligations), liability for injury to life, body and health and liability for gross negligence and wilful misconduct. The same applies to liability for negligence of the vicarious agent or the legal representative. In the above matters, liability is unlimited. This applies for direct damages as well as for indirect damages.

§ 7 Transfer of Usage Rights

The copyright remains with the Trainer grant SDN the right to make their contributions permanently accessible to the workshop users. SDN has the right to promote the workshops topics. Delivery to a third party is prohibited.

§ 8 Contract Cancelation

(1) Upon conclusion of the contract, there are different period for rescission:

(1.1.) The period for rescission form an SDN Talk is two weeks.

(1.2.) The period for rescission from an SDN Workshop is 30 days.

(1.3.) The period for rescission from a private use of the Loft33 is two weeks.

(2) If you dismiss these periods of cancelation there is no defund warranty.

(3) In case of good cause, in particular in the event of violation of usership obligations stated in § 5 of these Terms and Conditions SDN is entitled to promptly cancel the contract without setting a period of notice.

§ 9 Final Provisions

(1) The language of the contract shall be German or English.

(2) The laws of the Federal Republic of Germany apply exclusively.

(3) The sole place of fulfilment for delivery, performance and payment is Cologne if the User is an entrepreneur in the sense of § 14 German Civil Code (Bürgerliches Gesetzbuch).

(4) If any provision in these terms and conditions shall be held to be illegal, invalid or unenforceable, in whole or in part, then such provision or part of it shall, to the extent that it is illegal, invalid or unenforceable, be deemed not to form part of these terms and conditions and the legality, validity and enforceability of the remainder of these terms and conditions shall not be affected.

SDN Accredited Trainers

§ 1 Introduction

(1) The Service Design Network (hereinafter referred to as “SDN”) welcomes all service design professionals to become SDN Accredited Trainers  (hereinafter referred to as „Accredited Trainers”).

(2) We may change these terms and conditions at any time by updating this page and we will actively inform you about changes. We will consider that you have accepted changes if you do not object.

§ 2 Service Design Network Accredited Trainer

SDN welcomes all individuals or groups of individuals within companies and organisations who are conducting training and educational/enabling activities within the domain of Service Design to become Accredited Trainers. There are two types of Accredited Trainers:

  • Service Design Trainer
  • Service Design Master Trainer/Coach

§ 3 Registration

(1) You will become an Accredited Trainer once your application was successful. By clicking on the “Apply” – Button you apply to become an Accredited Trainer. You will have to agree to these Terms & Conditions.. You will receive a notification that you have registered. Please make sure to also check your spam folder in case the message has been marked as spam.

(2) To apply, you need to fill the self-assessment form online.

(3) Our system will forward your application to the Accreditation Commission after we have received your application fee of 180 Euro.

(4) The Accreditation Commission will evaluate your self-assessment. In case of positive evaluation you will be invited for an interview. In case of successfully passing the interview you will be given the title SDN Accredited Trainer or SDN Accredited Master Trainer/Coach as soon as the final payment has been drawn.

(5) The Accredited Trainer is not permitted to leave the access details and benefits like badges, certificates, discount codes to a third person and is responsible for keeping the access data confidential and preventing unauthorized use by third parties.

(6) The Accredited Trainer becomes automatically an SDN member for a period of 2 years. By applying for the Accredited Trainer status the terms and conditions for SDN membership are automatically accepted.

§ 4 Price Components and Methods of Payment

(1) The Accredited Trainer fee is 1.800,00 EUR for two years (including taxes). SDN Members pay a fee of 1.620 Euro for two years (including taxes). You can only pay with credit card.

(2) Accredited Trainer status is active for a 24 months period starting from the date of accreditation.

(3) A 180 Euro down payment will be charged with the application – the rest of the fee will be drawn from your credit card after successfully being accredited.

(4) After two years a simplified re-accreditation is available.

§ 5 Accredited Trainer Obligations

(1) As an Accredited Trainer you agree not to transmit any illegal or unlawful contents in your educational offerings. You are particularly obliged not to distribute any contribution

  • that would constitute a crime or administrative offence,
  • that infringes copyrights, trademark rights or competition regulations,
  • that infringes the Legal Services Act (Rechtsdienstleistungsgesetz),
  • that has offending, racist, discriminating or pornographic content,
  • that contains advertisements.

(2) As an SDN Accredited Trainer you confirm that all information is given honestly and after the best of your knowledge

(3) As an SDN Accredited Trainer you commit to refer in your trainings to the SDN Service Design Glossary – of course you are free to reflect on it and evolve it – but it should be used as a baseline for terminology and definitions.

(4) As an accredited trainer you grant the right to the SDN Accreditation Committee to have access to participants evaluation of the quality of your training.  A standardised tool will be provided by SDN.

(5) SDN has the right to withdraw accreditation in the case that there are multiple negative evaluations from participants of your training.

(6)  SDN has the right to delete contributions of a Member/ Accredited Trainer that may contain a statutory violation.

(7)  SDN has the right to be indemnified by the Member/ Accredited Trainer against third party claims due to a statutory violation by the Member. The Member is obligated to support SDN in defending the claim of respective demands and bear the costs for an adequate legal defense.

§ 6 Limitation of Liability

(1) To the maximum extent permitted by law, we accept no responsibility for any loss, which may arise from reliance on information contained in this website or other sites, which may be linked to our site from time to time.

(2) SDN assumes no liability or responsibility for the accuracy, completeness, reliability, up-to-dateness and usefulness of the provided content of the respective Accredited Trainer. Please note that statements of fact and opinion are made on the responsibility of the authors alone and do not represent the views of SDN.

(3) Claims for damages are excluded unless otherwise agreed below. This exclusion of liability also applies for legal representatives and vicarious agents of SDN.

§ 7 Transfer of Usage Rights

The copyright remains with the Accredited Trainer. Accredited Trainers grant SDN the right to make their contributions accessible to the public.

§ 8 Termination of Accredited Trainer Status

(1) The Accredited Trainer status and the SDN membership automatically terminate after 24 months unless a re-accreditation has taken place. The membership with SDN can be prolonged without re-accreditation if desired. If the accreditation and the membership are not prolonged the community follower role will be assigned.

(2) In case of good cause, in particular in the event of violation of membership obligations stated in § 5 of these Terms and Conditions – Membership, SDN is entitled to promptly close the access of the Member und terminate the membership without setting a period of notice.

(3) As a result of termination SDN is entitled but not obligated to delete the contributions of the Member on the site. Moreover SDN will close the member access.

(4) After expiry of deadlines as per tax-related and commercial regulations these data will be deleted unless you have expressly consented to its further use.
